Odds Of Winning A Workers’ Comp Case

Odds Of Winning A Workers’ Comp Case

Most workers are eager to know their chances of winning a workers comp case and trust me; this is not a dumb question. Based on a recent survey, many Americans live from one paycheck to another, which tells you that one family out of four in America has what it takes to keep meeting up with their expenses if they ever lose their job.

If a worker gets disabled due to an injury suffered at work, then the family hopes that money to be paid as compensation would come when it is supposed to. You could be devastated if conditions are standing in your way of receiving your worker’s compensation.

However, there are certain things that you can do if you feel you have to fight your way through obstacles to receive your worker’s compensation, and these tips would also boost your chances of success.

Fighting your way through litigation is never an easy process, and it is also essential that you speak with an attorney for my guidance and expert tips on how to win your worker’s comp case. The odds of winning a workers comp case can also be in your favor if you take the tips we have to give into consideration.

Keep A Diary

You should have a diary that would help you keep records of the date of injury, the date you filed a report, the date you notified your insurer of the accident, therapy sessions, surgeries, medical appointments, and absence from work.

Stay Away From Social Media

The fact is, if you want the odds of winning a workers comp case to be in your favor, then you would have to stay off social media until everything is over. This is because something you post on the internet could end up being used against you.

This is why it is important to discontinue social media, especially if you are away from work and recovering or receiving treatment. Also, ensure no one takes a picture of you and posts it on the internet.

Makes Sure All Calls Are Documented

No matter who you speak with, whether it is an insurance adjuster, the doctor’s office, or your employer, ensure that you document all of these calls, the name of the person who spoke with you, and the time of the call.

What you discussed on the phone is very important as well, and you should also know that doctors’ offices and insurance companies also document all of their calls too so documenting your own calls is still in place. Failure to document your calls means you might not be able to recall things you must have talked about. What you talked about on the phone could help win a workers comp case.

Watch What You Say To An Insurance Adjuster

You should also know that an insurance adjuster takes a record or documents any conversation he has with an accident or injury victim. You should also be aware that an insurance adjuster doesn’t work for you but has only the insurance company’s best interests at heart.

Commenting on anything to an insurance adjuster goes directly into their records, and even though a recorded conversation protects both parties, it is something you should never agree to do. Insurance adjusters don’t work for you.

Seek Legal Advice

The best way to boost your odds of winning a workers comp case is by seeking legal advice from an experienced attorney. It would help if you tried to do this before the case gets to litigation. It would also interest you to know that most attorneys who handle workers’ compensation cases actually do not charge for the consultation. It would help if you had a clear understanding of your responsibilities and rights before you end up in trouble or on the wrong side of the law.

Workers compensation cases or litigation isn’t ordinary as it might sound because it takes a lot to win one. This is clearly because anyone would fight for the benefits they feel they deserve. The truth is that sometimes claims might get denied, and the need to litigate your entitlement would definitely arise.

Doing the five things that we have listed in this review would certainly boost your odds of winning a workers comp case.

I had an injury happen at work a few years ago and was able to file a workers’ comp claim fairly easily and had a pretty quick recovery thanks to the help of a nurse case manager. It was not a fun process, but I was able to get back on my feet in just a few weeks.
