Whether the accident happens at a store or work, a slip and fall accident is an event that commonly happens. Sometimes the floor might be wet or slippery, while in other cases, there might be an obstruction on the way that might trip the foot, causing a person to slip and fall to the ground. Regardless of the cause, if a person sustains an injury at a public or workplace due to a slip and fall accident, then the owner of the place or insurance company would be held liable. Determining a slip and fall at work settlement requires considering several factors, and some of these factors include liability and negligence.

Even though several injuries a person might suffer due to a slip and fall accident, compensation gets to be awarded in various injury categories, pain and suffering, attorney fees, and payment of medical bills. Other factors would influence a slip and fall accident settlement, and these factors in most cases revolves around three main questions;

  • Did the injured person contribute to the slip and fall accident
  • Was the liable party negligent or acted in a way to contribute to the accident
  • Which party is generally liable for the cause of the accident

This here talks about the disregard for the safety of other persons by refusing to act in a reasonable way everybody would act. It could be possible that the slip and fall accident happened due to an uneven surface, a leaking ceiling, and a dangerous pothole. What negligence means in this context is if a particular individual should have been able to identify the dangerous pothole, for instance, or if the individual took advantage of opportunities to work on the place and prevent the possibility of an accident happening.

One thing that needs to be proved here is if the property owner can be held liable or specifically is the cause of the dangerous situation that led to the accident. There are factors that one has to consider when trying to determine negligence. These factors include failure to implement company policy, poor visibility, poor lighting, lack of reasonable justification, and more.

Liability

Suppose you want to prove that someone is liable for an accident. In that case, the person must take legal ownership or responsibility for the property and any event on the property. Suppose you are a property owner or a business owner. In that case, it is common for you to take up liability for any injury that happens at your place of business or property. If the business owner or property has liability insurance, then it falls to the insurance company to handle the liability. Therefore, it is within the plaintiff’s legal rights to file a complaint against the insurance company instead of the owner or the business or property.

Types Of Compensation

In slip and fall cases, general compensation for damages would likely be awarded. These are the awards used to compensate an individual for damages that are not related to money. Such damages include;

  • Mental Anxiety
  • Pain And Suffering
  • Loss Of Companionship

However, in the cases of special compensatory damages, they refer to awards used in compensating an individual for damages that are money-related. Such damages include;

  • Household bills and other necessities
  • Cost of medical services required in the future
  • Attorney fees
  • Medical bills

There are still two key factors that help determine how a slip and fall settlement should go when you consider these. Liability and negligence are the two main determining factors that suggest which way a slip and fall settlement should go. Still, the plaintiff or injured individual should not be held liable for causing or contributing to the accident. There are also other things to consider like pain and suffering, medical bills, and legal fees.

Common Injuries That Are Associated With The Slip And Fall Accident

Many injuries might arise due to a slip and fall accident, and they can range from just bumps to bruises. They can also result in permanent disability; even though there are so many injuries to consider, some happen around the pelvic, neck, back, and head area. An individual is likely to suffer from torn ligaments as a result of a slip and fall accident.
