Where Is My Workers Comp Settlement Check

Where Is My Workers Comp Settlement Check

Often, injured workers wonder how long it would take to get their workers’ comp settlement check. However, if you have settled for an offer from your employer or his insurance company, then your worker’s comp settlement check should arrive with the same increments, just like when you were still working.

If your wage arrives every two weeks, your worker’s comp settlement check should also arrive every two weeks. “Where is my worker’s comp settlement check” is a question that keeps popping up, and this is because delays are bound to happen. If there is a delay, then it is up to your attorney to contact the insurance company.

Discontinued Workers Comp Benefit

There are so many reasons that could cause a workers comp settlement check to get discontinued. If the insurer claims that he has a reasonable basis for terminating your worker’s comp settlement check, then they have to issue you a notice of intention to discontinue benefits.

They also have to state critical reasons why they want to stop your worker’s comp settlement check on this form. For example, a common reason why an insurer would discontinue settlement checks is if the injured worker has doesn’t have work restrictions.

Another reason could be if the doctors say the worker doesn’t need work restrictions or has already returned to work. However, if you notice intention to discontinue benefits but are still on work restrictions with lesser pay, you need to speak with your attorney.

Your attorney would request a 239 conference with the insurer to discuss why wages got discontinued. If the judge also finds out that your benefits got suspended improperly, you would have your benefits reinstated.

The insurer also gets a fourteen-day duration from the judge to pay out your worker’s comp settlement check.

Denied Workers Comp Benefits

If your worker’s comp benefits get denied, or maybe a hearing is in the process, then it might take a little while for your compensation to get paid. You would not receive any worker’s compensation settlement check if your claim got denied.

You will only get paid if a worker’s compensation judge decides the case in your favor. It takes about sixty days for the judge to come up with a decision in such a hearing. If the case ends in your favor, the insurer must pay the compensation in about fourteen days.

The fact is most injured workers find it challenging to meet up with their bills while waiting to receive their worker’s comp settlement check. Therefore, it is always the right decision to speak with an attorney because he would inform you of the financial resources and options available to you.

Workers Compensation Settlement Process

Filing a claim means the insurer has received your information, then both parties can settle the paperwork quickly. Next, your attorney would get a copy and ensure that everything gets adequately documented. They will send it to you later for your review and signature.

Before signing, ask your attorney to explain the document to you. Then, after all other processes get followed, your employee and his insurer would sign. Once everything gets completed, the judge would receive the paperwork for review.

If there are no issues with the document, the judge will issue an award. All the parties involved would receive the prize, and the insurer has fourteen days from when he received your pay from issuing your check.

Judging from all of the processes involved, you can see that the worker’s compensation settlement process is very complicating. An injured worker can’t handle this personally, but he needs an experienced worker’s compensation lawyer to take care of everything for her.

An experienced worker’s compensation lawyer would help you get all of your benefits. He would also inform you of what legal options are available to you. The standard mail service is the typical way of sending settlement checks across.

However, the standard mail gets referred to as snail mail. Snail mail means that despite every document getting approved, it can still take some time for the check to get to you. Just like we said earlier, delays are bound to happen.

If your settlement check is more than two weeks late, then you should check with your insurance provider. It will arrive late because sometimes, they might forget your settlement check on someone’s desk.
